A R&B singer named De Rico is suing Justin Bieber and Usher for $10 million in damages for ripping off his song "Somebody to Love," reports Reuters . De Rico, otherwise known as Devin Copeland, is claiming that three Bieber-Usher tracks constitute copyright infringement by way of "beat pattern, time signature, and similar chords and lyrics."
De Rico originally filed the lawsuit two years ago. It was initially thrown out by District Judge Arenda Wright Allen; the 4th U.S. Circuit Court of Appeals in Richmond, Virginia voted by a 3-0 margin on Thursday to return the case to Judge Allen.
"After listening to the Copeland song and the Bieber and Usher songs as wholes, we conclude that their choruses are similar enough and also significant enough that a reasonable jury could find the songs intrinsically similar," Circuit Judge Pamela Harris wrote.
